MLC Code2006
As a company, TYS Recruitment holds the employment rights of the seafarers we work with the utmost importance. To promote this, we have chosen to comply with MLC code 2006, which can be found here, and have implemented the following procedures:
- Each candidate registered to our agency undergoes interviews with our agents that are handled precisely the same irrespective of blacklists, nationality, age, gender and race, as per MLC A1.4.5(a).
- We ensure that no discriminatory practices, such as blacklisting, hinder qualified candidates from securing employment, as per MLC A1.4.5(a).
- We strictly prohibit any exchange of remuneration or benefits between candidates and our agency, as per MLC A1.4.5(b).
- We refrain from placing candidates under the age of 16 on yachts or under the age of 18 in the galley, as per MLC A1.4.5(a).
- The seafarer is expected to fund their own basic mandatory qualifications for employment (STCW10, MCA ENG1 medical certificate or approved equivalent, and a valid Passport or similar travel document); and rank and positions that require additional documentation, such as CoC’s. Additionally, vessels which are MLC-compliant must cover any visa related costs associated with the seafarer, as per MLC A1.4.5(b).
- We maintain an updated registry of all seafarers placed through our agency, as per MLC A1.4.5(c)(i).
- We maintain an updated list of vessels for which we work with and place candidates, as per MLC A1.4.5(c)(i).
- Seafarers are informed of the rights and obligations under their employment agreements before engagement, as per MLC A1.4 para 5(c)(ii).
- Seafarers that re recruited by our company undergo comprehensive reference checks to ensure suitability and qualifications for the position, as per MLC A1.4 para 5(c)(iii).
- Employment agreements of seafarers align with Flag State laws and regulations, including any Collective Bargaining agreement (CBA), as per MLC A1.4. 5(c)(iii).
- We take measures to prevent seafarers from being stranded in foreign ports to the best of our ability, as per MLC A1.4. 5(c)(iv).
- We promptly address and report any complaint about our operation to the relevant authorities, accessible to all, as per MLC A1.4. 5(c)(v)
- Our insurance policy covers any failure on our part to meet the obligations of the employment agreement, as per MLC A1.4.5(c)(vi).
- We uphold the confidentiality of each candidate and their personal information and will only share their CV or details with third parties upon their consent, as per MLC B1.4.1. 1(d).
